Dancing Cubs: Terms and Conditions of Hire

1. Introduction

These Terms and Conditions govern the hire of play equipment from Dancing Cubs ("we," "us," or "our") by the Client. By placing an order, the Client agrees to be bound by these terms.

2. Definitions

  • "Client/Hirer" refers to the individual or entity hiring the Dancing Cubs play equipment.
  • "Equipment" refers to all items and play equipment rented/hired from Dancing Cubs.
  • "Hire Period" refers to the agreed-upon duration of the equipment rental.

3. Booking and Payment

  • Bookings: Bookings are made through the Dancing Cubs website (www.dancingcubs.co.uk) or by contacting us directly at hire@dancingcubs.co.uk.
  • Deposit: A deposit is required to secure the booking, as outlined in the Invoice.
  • Full Payment: Full payment is due in full any day before the delivery date, unless otherwise agreed in writing.
  • Payment Methods: Balance payments can be made by bank transfer.

4. Delivery and Collection

  • 4.1 Delivery
    • Access: The Hirer is responsible for providing full and accurate information about the venue/location. This includes details regarding loading bay access, including address, vehicular access dimensions (height, width, length), and any specific requirements (e.g., lift access, weight restrictions).
    • Trolley Space: The Client must ensure adequate space for our trolleys to maneuver safely within the venue. Trolleys require a minimum turning radius of 2 meters and require a clear width of 2 meters to pass through doorways and corridors.
    • Parking: The Client must ensure adequate parking space for the delivery vehicle. Parking in restricted areas (e.g., bus lanes, double yellow lines) is prohibited and any associated fines will be the responsibility of the Client.
    • Site Access: The Client is responsible for ensuring safe and unobstructed access for the delivery team to the designated setup area.
    • Client Presence: The Client or a designated representative must be present at the time of delivery to:
      • Guide the delivery team to the designated setup area.
      • Inspect the delivered equipment for any damage or discrepancies.
    • Delivery Times: Delivery times are estimates and may be subject to unforeseen delays (e.g., traffic, weather).
    • Late Deliveries: If the delivery is delayed by more than 1 hour, the Client will be notified promptly. A partial refund may be offered for significant delays, at the discretion of Dancing Cubs.
  • 4.2 Collection
    • The Client is responsible for ensuring the play area is clear of children and that all equipment is clean and undamaged before our arrival for collection.
    • Bags for collected balls from ball ponds must be provided by the Client.
    • The Client or a designated representative must be available at the time of collection.

5. Equipment Use and Safety

  • Supervision: Continuous adult supervision is mandatory for all children using the play equipment.
  • Safety Guidelines: Clients must adhere to all safety guidelines provided by Dancing Cubs, including those outlined in the "Safe Play Guidelines" document.
  • Prohibited Activities:
    • No shoes, food, or drinks are permitted on the play equipment at any time.
    • No rough play, climbing on fences, or jumping from the equipment.
    • No face painting, party poppers, coloured streamers, or silly string should be used near the play equipment.
  • Damage Prevention:
    • Children should be supervised to prevent damage to the equipment.
    • Nappy changes are not permitted on the play equipment or play mats.

6. Equipment Care

The Client is responsible for the care of the play equipment during the hire period. This includes:

  • Damage:
    • Any damage to the equipment will be assessed, and repair or replacement costs will be charged to the Client.
    • If significant damage occurs, the Client may be liable for the full replacement cost of the damaged item(s).
  • Venue or Property Damage: The Client is responsible for any damage to the venue or property caused by the use of the play equipment.

7. Cancellation and Postponement

  • Cancellation: Cancellation policies are outlined separately in the Booking Confirmation.
  • Postponements: Postponements are subject to availability and may incur additional charges.

8. Liability

  • Client Responsibility: The Client assumes full responsibility for the safety and well-being of all children using the play equipment.
  • Dancing Cubs Liability: Dancing Cubs is not liable for any injuries or accidents that may occur during the use of the play equipment, except for those arising from proven negligence on the part of Dancing Cubs.

9. Intellectual Property

All intellectual property rights in relation to the Dancing Cubs brand and materials belong to Dancing Cubs.

14. Changes to Terms and Conditions

We may update these Terms and Conditions from time to time. Any changes will be posted on our website.
